Selling a Car With No Title or a Title Problem in California

A title problem doesn't always stop a sale, but it does change what has to happen first. Here's an honest look at the most common situations in California, what the DMV requires, and what to tell us before you sell.

The short answer

No title? We can work with you. Many title problems can be fixed with the right DMV paperwork, and some take a little time. Tell us what you have and we'll walk you through what can be done.

Lost or damaged title, vehicle in your name

This is the most common case and usually the easiest. California's Application for Replacement or Transfer of Title (REG 227) is used when the title is missing, and it can be used to transfer ownership. If a lender is listed on the vehicle, the lender's release on that form has to be notarized.

You still owe on a loan

The lender (the "legal owner") holds the title until the loan is paid off. The loan has to be paid as part of selling. Call us with the lender's name and your payoff amount and we'll talk through how that would work for your vehicle.

Loan paid off, but the lender is still on the title

You'll need a lien release from the lender. California uses a Lien Satisfied/Title Holder Release form (REG 166), or the lender can sign off on the title itself. Contact the lender first if you don't have it.

The owner has passed away

A family member can't just sign the title in the owner's place. California has a no-probate transfer for some estates using an Affidavit for Transfer Without Probate (REG 5). It has a waiting period after the death and value limits, and it only applies to California-titled vehicles. If the estate is in probate, the executor or administrator handles the transfer.

You bought it, but the title was never transferred to you

If you have the old title signed by the previous owner, that's often enough to work with. If you don't, you'll need the previous owner's help or the DMV process for missing ownership documents. Tell us what you have.

Out-of-state title

A vehicle titled in another state can be sold, but the paperwork is different. A replacement title has to come from the state that issued it. Call us with the state and whose name is on the title.

No proof of ownership at all

When regular ownership documents can't be obtained, the DMV may accept a Statement of Facts (REG 256) together with a vehicle bond or a deposit instead of a bond. This is sometimes called a bonded title. It usually also involves an Application for Title or Registration (REG 343) and a Verification of Vehicle (REG 31). It takes time, and the DMV reviews each application, so it helps to start early. We can work with you through it.

Salvage and nonrepairable titles

Payment and pickup

Once the paperwork is in order and you accept our offer, we pay you in cash at pickup, before the vehicle leaves, and towing is free. After the sale, file a Notice of Transfer and Release of Liability with the DMV within 5 calendar days.
